NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE OF SERVICES WILL NOT IMPROVE CHANCES OF WINNING. THE FOLLOWING SWEEPSTAKES IS VALID ONLY IN OHIO, KENTUCKY, INDIANA, AND ILLINOIS, AND IS OPEN ONLY TO PERSONS AT QUALIFIED SERVICEABLE LOCATIONS (AS DEFINED IN THE RULES BELOW). IT IS SUBJECT TO APPLICABLE FEDERAL, STATE AND LOCAL LAWS, RULES AND REGULATIONS AND IS VOID ELSEWHERE AND WHEREVER PROHIBITED BY LAW OR REGULATION. DO NOT PARTICIPATE IN THE SWEEPSTAKES IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.
Sweepstakes Name: ‘Oculus Giveaway’ (the “Sweepstakes”)
Entry Period: The Sweepstakes entry period is scheduled to begin at 12:00:00 am EST on 10/28/2024 and end at 11:59:59 pm EST on 11/27/2024 (the “Entry Period”).
Who May Enter: Entrants may enter the sweepstakes as individuals or a household residing at the same address. The individual and household will be collectively considered as a single “Entrant” for the purpose of selecting winners and awarding prizes.
Entrants must be legal residents who reside within the WATCH COMMUNICATIONS territory as defined by county and state who are at least 18 years of age, as of the date of entry, and have valid U.S. identification, except for the following classes of persons who are not eligible to enter, participate or win:
(a) Employees, officers, shareholders, and directors of Watch Communications and Benton Ridge Telephone, and each of their respective franchisees, affiliated companies, subsidiaries, printers, advertising, and promotion agencies, and any and all other companies associated with the design or execution of this Sweepstakes (collectively, “Released Parties”) and the members of the immediate families or households of any of the above, whether or not related. “Immediate family members” include, for purposes of this Sweepstakes, parents (including in-laws), grandparents, siblings (including stepsiblings), children (including stepchildren), grandchildren (including step grandchildren) and each of their respective spouses.
(b) Individuals who do not have a valid email address to register.
(c) Individuals who are not eligible for wireless Internet service but do have access to Fiber Internet from Watch Communications or Community Fiber Solutions.
How to Enter – Online Entry: Visit https://watchcomm.net/ during the Entry Period and follow the online instructions to complete an entry in the Sweepstakes. Each entrant must fully complete the online entry form with all required information including complete name, complete address (including city, state and zip), age, valid email address and phone number (including area code). If entering for an individual other than themselves, or a household, each Entrant hereby acknowledges that Nominee has full authority and permission to provide the foregoing information on behalf of such Entrant(s), and hereby releases Administrator from all liability in connection therewith. Limit one address (household or individual) per Entrant.
If Entrant is unable to submit an entry form online, a typed entry form with Entrants name, address, city, state, zip, phone, and email can be mailed to: Watch Communications, Attention: Inside Sales Team, 807 S State Rd 3 Rushville, IN 46173. Mailed entries must be received by 11/27//2024 to be eligible for drawing.
After having read and agreed to these Official Rules, click the submit button on the entry registration page to submit your entry. All eligible entries received must be fully completed with all required information. Any online entry submitted with an invalid email address or incomplete information will be disqualified. Maximum of one entry per household address. Submitting multiple entries will not improve chances of winning. Eligible entries must be submitted and received by 11:59:59 pm EST on 4/30/2024. All other entries will be ineligible to participate or win any prize.
Any available opt-in opportunities are not required to enter the Sweepstakes, and checking the opt-in boxes will not improve your chances of winning. By participating and submitting an entry, the entrant agrees that the Administrator and all other participating parties are authorized to contact Entrant and/or the Nominee(s) via email, mail, phone or any other form of media to make the Entrant and/or the Nominee(s) aware of information pertinent to the Sweepstakes, and to distribute information regarding the Administrator’s featured products, special events or promotional offers, or purchase incentives. Entrants and/or Nominees may opt-out of any further email communication at any time by simply replying REMOVE to any email message or following the provided opt-out instructions.
Privacy: By submitting an entry into the Sweepstakes, you hereby expressly acknowledge and understand that you are providing your personal information, or that of your Nominee, to the Administrator. To view the Administrator’s privacy policy, please visit https://watchcomm.net/privacy-statement/. You may also request a copy of the privacy policy by contacting the Administrator at their respective mailing addresses listed below.
Released Parties are not responsible for entries that are lost, late, misdirected, illegible, incomplete, invalid, unintelligible, or damaged, or for entries submitted in a manner that is not expressly allowed under these rules, or for any entry not submitted or received due to any technical error or failure, human or programming errors, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information for any reason, or effects of hackers or failure of any electronic equipment, computer transmissions and/or network connections; all of which will be disqualified.
Any attempt by any entrant to obtain more than the stated number of entries allowed by using same, multiple/different email addresses, identities, or any other methods will void that entrant’s entries and that entrant or his/her Nominee will be disqualified. No mechanically reproduced or automated entries are permitted. Use of any automated system or professional entry agent to submit entries is prohibited and will result in disqualification, and all such entries will be deemed void.
In the event of a dispute as to any online entry, the authorized account holder of the email address(es) listed in the entry form will be deemed to be the Nominee, and he/she/they must meet the eligibility requirements set forth in these Official Rules. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. All entries received become the property of the Administrator and will not be returned.
Prize Awards & Delivery:
Grand Prize — a maximum of one (1) grand prize will be awarded to one (1) winner and will consist of the following:
Any Entrant or Nominee that is selected as a winner will be awarded one (1) weekly prize for the entire household address as a whole. Any Entrant or Nominee that is selected as a winner will be awarded one (1) grand prize for the entire household address as a whole.
All prizes will be communicated via email and phone by a representative of the Administrator to each Nominee or Entrant, who is a confirmed winner, at the phone number and email address provided by the entrant in the online entry form.
Administrator shall not be held liable if prize is delayed, damaged, or otherwise undeliverable for any reason.
Selection & Notification:
Potential winner(s) will be notified initially by email and phone, within 24 hours of selection dates listed above. If the Administrator is unsuccessful in its attempt to reach and speak directly with a potential winner, after two attempts over a 96-hour period, by calling the phone number listed on that winner’s entry, then that winner may be disqualified, and an alternate potential winner may be randomly selected from among the remaining eligible entries and notified as per the procedures outlined above (time permitting). Note: phone messages will not be left during the winner notification process.
During the winner notification call, the selected potential winner must confirm their eligibility and indicate their willingness to accept the designated prize. Any disqualified winner will not receive any alternate prize substitution or compensation. Maximum of one (1) prize per household. Decisions of the Administrator in the selection and determination of prize winners and all matters relating to this Sweepstakes are final and binding.
All of the following will apply to the potential prize winner(s): 1) Winner will be required to complete and return, within two (2) days of receipt, a prize acceptance form, an affidavit of eligibility, and a liability/publicity release (where permitted) signed by the winner; 2) Winner may be required to present a copy of a valid driver’s license or government-issued photo I.D. as a condition of participating or receiving any prize; 3) Unless otherwise stated in these Official Rules, winner will be responsible for paying all installation and equipment fees, and all other fees detailed in the open internet policy https://watchcomm.net/open-internet-policy/, and applicable taxes, (including, but not limited to, all local, state and federal taxes) on all prizes awarded. The foregoing requirements will apply to each individual and household that is selected as a winner. Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If the prize is forfeited for any reason, winner will not receive any other prize substitution or compensation, and the prize will remain the property of Administrator and will not be awarded, except as provided herein.
Additional Rules & Restrictions: By participating, entrants agree to abide by and be bound by the Official Rules and the decisions of the Administrator, which shall be final in all matters relating to this Sweepstakes. In the event an Entrant/Nominee wins a prize and is later found to be in violation of these rules, he/she will be required to forfeit the prize or to reimburse Administrator for the stated value of the prize if such violation is discovered after the winner has received the prize. Participation in the Sweepstakes constitutes permission for the
Administrator and its designees to use Entrants’ and Nominees’ names, cities, and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent, or deceptive entries or acts shall render entrant’s ineligible for any prize.
By participating, entrants agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental, or consequential, for injury (Including but not limited to death), damages, losses or expenses arising out of or relating to Entrant’s participation in this Sweepstakes, or the acceptance, possession, or use/misuse of any prize, or participation in prize-related activities (including, but not limited to, transportation or any other activity related thereto), and to assume all liability therefor.
Released Parties shall not be liable to any winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, service obstructions, no acceptable signal, out of network or unserviceable addresses, unforeseen equipment requirements or restrictions, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, diseases, epidemics, pandemics or quarantine, and government laws, regulations, or orders or other actions or any other cause beyond Released Parties’ sole control.
Entrants are restricted to use of ordinary and typical computer equipment, mobile phone, equipment, internet access and cellular networks to enter Sweepstakes. Administrator disclaims all liability for the inability of an entrant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Administrator’s control, or otherwise. The Administrator disclaims any liability for any entries not received due to technical difficulties or transmission errors. The Administrator disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Released Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions, or failures of any kind, including failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the internet or at any website or lost or unavailable network connections which may limit an online entrant’s ability to participate in the Sweepstakes, and any injury or damage to entrant’s or any other person’s computer or mobile phone related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. Released Parties are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Sweepstakes, including, without limitations, errors which may occur in connection with the receipt or data storage of entries, printing or advertising of this Sweepstakes, administration, or execution of the Sweepstakes, the processing of entries or in the announcement of the prizes or prize winners.
Any entry not received, lost, damaged, or destroyed for any reason is not eligible to participate in the Sweepstakes. Administrator, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Sweepstakes website.
Administrator reserves the right to cancel, modify or terminate the Sweepstakes if fraud, misconduct, release of the grand prize winning number, or technical failures destroy or threaten the integrity of the Sweepstakes, in the opinion of the Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Administrator, in their sole discretion. In the event of early termination of the Sweepstakes, Administrator reserves the right to terminate the Nomination Period, and execute the Sweepstakes drawing by selecting a winner from among all eligible, non-suspect entries received as of the time/date of such termination. If, due to circumstances beyond the control of Administrator, any event associated with his Sweepstakes or the prize is delayed, rescheduled, postponed, or cancelled, Administrator reserves the right, but not the obligation, to cancel or modify the Sweepstakes, and Administrator shall not be required to award a substitute prize.
IN CASE OF DISPUTES: By participating, each Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Ohio; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney fees: and (3) under no circumstances will any Entrant or Nominee be permitted to obtain awards for, and Entrant and Nominee hereby waive all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
This Sweepstakes shall be governed by, construed, and interpreted under the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Ohio or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Ohio.
Odds: The odds of winning a prize depend on the number of eligible entries received in the Sweepstakes.
Official Rules & Winners List: For a copy of these Official Rules or the name of any prize winner(s), send a self-addressed stamped envelope to be received by 5/10/2024 to: Watch Communications, c/o Marketing, 275 Grandview Drive, Suite 175, Ft. Mitchell, KY 41017. PLEASE SPECIFY which you are requesting: Official Rules or Winners List. Names of prize winners, if any, will not be available until after 12/30/2024.
